1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and SubHarbor (“we,” “us,” or “our”), concerning your access to and use of the subharbor.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Service”). You agree that by accessing the Service, you have read, understood, and agreed to be bound by all of these Terms and Conditions.
2. Service Description
SubHarbor provides a platform for Reddit moderators to create and manage public backup landing pages for their subreddits. These pages contain user-provided information, such as outbound links to community mirrors (e.g., Discord, Lemmy) and introductory text, accessible via a permalink (e.g., `subharbor.com/r/[subreddit]`). The Service is intended as a fallback resource in case of Reddit disruptions.
3. User Eligibility and Responsibilities
- Eligibility: To manage a subreddit page on SubHarbor, you must authenticate via Reddit OAuth and be verified as a current moderator of that subreddit.
- Accurate Information: You agree to provide accurate and complete information when using the Service and to update your information as necessary.
- Content Responsibility and Standards: You are solely responsible for the content you post on your subreddit’s backup page, including links and text. You represent and warrant that you have the necessary rights to share this content and that it does not violate any laws or third-party rights. Furthermore, you agree not to post or link to content that:
- Is illegal or promotes illegal activities.
- Is hateful, discriminatory, defamatory, or harasses individuals or groups.
- Contains or promotes sexually explicit material, gratuitous violence, or content that exploits, abuses, or endangers children.
- Infringes upon the intellectual property rights of others (e.g., copyright, trademark).
- Contains malware, viruses, or other malicious software.
- Is designed to deceive or mislead others, such as phishing attempts or spam.
- Lawful Use: You agree not to use the Service for any unlawful purpose or in any way that could harm, disable, overburden, or impair the Service.
- Account Security: You are responsible for maintaining the confidentiality of your authentication method (Reddit account) and for all activities that occur under your association with a subreddit page.
4. Intellectual Property Rights
Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. The Content and the Marks are provided on the Service “AS IS” for your information and personal use only.
Content you provide for your subreddit page remains your property, but you grant us a worldwide, non-exclusive, royalty-free license to display that content as part of the Service.
5. Prohibited Activities
You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to: systematic retrieval of data; unauthorized framing of or linking to the Service, or linking from the Service to content that violates our Content Standards (as detailed in Section 3); interfering with security features; harassing or abusing other users or our staff; or using the Service in a manner inconsistent with applicable laws.
6. Service Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Service without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
We cannot guarantee the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. 8. Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Service; (2) breach of these Terms and Conditions; (3) any breach of your representations and warranties set forth in these Terms and Conditions; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Service with whom you connected via the Service.

We reserve the right, in our sole discretion, to terminate your access to the Service, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users of the Service, us, or third parties, or for any other reason.
